The clauses below are required reading before any deposit is processed. They are also presented during checkout, where you must explicitly acknowledge them.

Section A

50 / 50 Transaction Split

Due Today (50% Non-Refundable Deposit)

System processes exactly 50% of the calculated grand total immediately to secure the deployment slot. This deposit is non-refundable upon scheduling.

Due Upon Job Sign-Off (50% Remainder)

The gateway securely saves tokenized card details for automated final balance capture upon project sign-off. Balances unpaid beyond 7 days accrue a 1.5% per month late fee.

Section B

Automated Travel Surcharge Engine

Base operations center: ZIP 33033. Surcharges are applied automatically based on the entered service ZIP.

  1. 0 – 30 Miles
    Standard operational layout. Travel fee calculated at $0.00.
  2. 30 – 45 Miles
    Auto-inject a mandatory travel overhead fee of +$149.99 directly to the cart subtotal.
  3. Over 45 Miles
    Automatic checkout halt. Location sits outside our automated flat-rate dispatch zone — please call our corporate estimating line directly.
Section C

Mandatory Photo Upload

Required: Upload a direct photo of your active wall/ceiling damage, layout space, or painting surface. Our corporate logistics team verifies the dimensions against your inputs prior to scheduling deployment. If a size or scope mismatch occurs, a coordinator will reach out to adjust your balance.

Iron-Clad Terms of Service

  1. 01
    Work Area Preparation Standards

    The client must establish a completely clear, unobstructed 6-foot workspace radius surrounding designated repair zones, wall builds, or painting faces. Goliath Drywall personnel are strictly barred from moving or handling client furniture, electronics, appliances, or personal property. If the site is not prepared when our crew arrives, a mandatory $149.99 mobilization / re-trip fee is charged to the card on file, and the job may be rescheduled at the company's discretion.

    Protection of Personal Property

    While Goliath uses standard drop cloths and dust containment, the client is solely responsible for moving, covering, or storing fragile items, electronics, artwork, instruments, and valuables prior to crew arrival. Goliath Drywall is not liable for damage to items left within the active work zone.

  3. 03
    Mechanical Infrastructure Exclusions

    Field technicians operate exclusively as finishing and structural drywall specialists. Our crews will not handle, modify, alter, or relocate hidden underlying utility infrastructure — including plumbing, electrical, gas lines, HVAC, or communication / low-voltage lines. Any such work must be performed by a licensed trade and is not included in any Goliath quote.

    Hidden / Pre-Existing Conditions

    Quotes are based on visible conditions at time of estimate. Concealed damage discovered during the work — including water damage, rotted framing, termite damage, prior improper repairs, structural settling, or code violations — is not included in the original price and will be addressed via a written change order at additional cost before work resumes.

    Scope of Work & Change Orders

    The deposit and final price cover only the work expressly described in the written proposal. Any addition, expansion, substitution, or modification requested by the client constitutes a change order and must be approved in writing and paid for separately before that work begins.

  6. 06
    Texture, Paint & Color Matching

    On existing walls and ceilings, Goliath provides a best-effort texture and paint match. Due to age, fading, lighting, lot variation, and prior coatings, an exact invisible match is not guaranteed. Full-wall or full-room repaints, if desired, are quoted separately.

  7. 07
    Environmental and Microbial Protocol

    If our field crew encounters active biological growth, mold, asbestos-suspect material, or unmitigated moisture leaks during cutout or surface preparation, all field production stops immediately. On-site operations will only resume once the client provides an official third-party certified clearance report. Any resulting delay is not the responsibility of Goliath Drywall.

    Site Access, Power & Parking

    Client must provide safe, legal access to the work area, functional water and electrical service, and reasonable parking for service vehicles. Delays caused by lack of access, locked gates, pets in the work area, or HOA / building restrictions will be billed at the standard mobilization rate.

    Scheduling, Delays & Rescheduling

    Start and completion dates are good-faith estimates, not guarantees, and may shift due to weather, material delays, prior jobs running long, or events beyond our control. Client-requested rescheduling more than 48 hours prior to the start date is free of charge. Cancellations or reschedules within 48 hours of the scheduled start result in forfeiture of the 50% deposit.

    Deposit, Final Payment & Late Fees

    The 50% deposit is non-refundable upon scheduling. The remaining balance is due upon project sign-off, charged to the card on file. Balances unpaid beyond 7 days accrue a late fee of 1.5% per month (18% APR), and Goliath reserves the right to file a mechanic's lien on the property. Returned payments / chargebacks incur a $50 administrative fee.

    Workmanship Warranty

    Goliath Drywall warrants its labor and finishing work for one (1) year from the date of project sign-off against defects in workmanship. This warranty does not cover normal settling cracks, nail pops from structural movement, water damage, customer damage, modifications by others, or cosmetic paint touch-ups after initial completion. Warranty is void if the final balance has not been paid in full.

    Permits, Code & HOA Approvals

    See Clause 19 (Permits, Licensing & Regulatory Exclusions) for the binding statement of scope. In summary: unless explicitly listed in the proposal, permits and HOA / condo board approvals are the client's responsibility, and Goliath will not begin permit-required work until the permit is in hand. Any code-upgrade work mandated by an inspector is a change order at additional cost.

  13. 13
    Limitation of Liability

    To the maximum extent permitted by law, Goliath Drywall's total liability for any claim arising out of or related to a project is limited to the total amount actually paid by the client for that project. Goliath is not liable for incidental, consequential, indirect, or punitive damages, including loss of use, lost profits, or relocation costs.

    Photo, Marketing & Privacy

    Goliath reserves the right to photograph completed work and use before/after images for marketing, social media, and portfolio purposes. No personally identifying information or addresses are published. Clients may opt out in writing prior to project start.

  15. 15
    Professional Workplace Environment

    We enforce a zero-tolerance framework for verbal abuse, harassment, profiling, intoxication on site, safety interference, or hostility toward corporate personnel. Violations result in immediate project termination, forfeiture of the 50% deposit, and the client remains liable for the cost of any work and materials completed up to that point.

    On-Site Estimate Fee, Scope Limits & No-Show Policy

    In-person site visits for residential estimates are billed at a flat $99.00 non-refundable site-visit fee, charged to the card on file at the time of booking. The fee covers technician drive time, on-site measurements of the drywall / paint / trim scope, and delivery of a written estimate by email (issued the same day for residential projects). Goliath Drywall technicians are drywall finishing and structural specialists only — they do NOT assess, test, sample, price, or remediate water damage, active moisture, mold, or other microbial growth, and will not touch or cut materials suspected of being wet or contaminated. Where active water damage or mold is present, the client must engage a separately licensed water-mitigation and/or mold-remediation company to complete cut-out, dry-out, and certified clearance BEFORE Goliath will measure or quote the affected area. The site-visit fee is still fully earned even if conditions on arrival prevent measurements (for example, wet materials, suspected mold, or no clearance report available). If the client hires Goliath Drywall for the quoted scope, the $99.00 site-visit fee is credited in full toward the 50% project deposit. A valid card on file is required to schedule any site visit. Cancellations or reschedules made less than 24 hours before the scheduled appointment window, no-shows, or inability to gain site access upon arrival result in full forfeiture of the $99.00 site-visit fee with no credit issued. Free online quotes via the photo-upload catalog (images plus measurements) remain available at no cost and require no appointment.

    Acceptance of Terms

    By submitting the deposit and checking the agreement box at checkout, the client acknowledges they have read, understood, and agreed to these Terms & Conditions in full. These terms supersede any prior verbal representations and constitute the binding agreement between the client and Goliath Drywall.

  18. 18
    Accuracy of Customer-Submitted Information

    All photos, measurements, square footage, linear footage, ceiling heights, and scope descriptions submitted by the client through the online catalog, photo-upload tool, or intake form are binding representations made by the client. Quotes and flat-rate package selections are calculated directly from this information. If on-site conditions reveal that the actual scope, dimensions, or ceiling height differs from the submitted information by more than 10% — or that conditions exist which were omitted from the submission (additional patches, taller walls, hidden damage, second coats, color matching across multiple lots, etc.) — the affected line items will be re-quoted in writing as a change order before any additional work begins. The original 50% deposit remains non-refundable in all cases, and the client agrees that scope corrections based on accurate on-site measurement are not grounds for refund, chargeback, or service credit.

    Permits, Licensing & Regulatory Exclusions

    All Goliath Drywall packages, bundles, and flat-rate services are quoted and sold as non-permitted cosmetic and finishing labor — specifically drywall installation, patching, skim coating, texture matching, painting, baseboard trim labor, and interior wall framing for non-load-bearing partitions. The following are expressly excluded from every quote and every package unless individually written into the signed proposal: municipal or county building permits, permit application fees, permit expediting, plan review, architectural drawings, structural or engineering stamps, impact-window or impact-door permits, roofing permits, electrical permits, plumbing permits, mechanical permits, energy-code compliance, HOA architectural review, condo board approvals, and any scope requiring a Florida Certified or Registered General Contractor (CGC / RGC) license — including but not limited to full bathroom or kitchen remodels with plumbing or electrical alterations, room additions, load-bearing wall removal or modification, exterior structural work, and roof or envelope penetrations. The client is and remains the permit applicant of record for any work that may require a permit; Goliath will not file, pull, or sign for permits on the client's behalf. If a permit is required for a scope the client wishes to add, Goliath will pause that portion of work and refer the client to a licensed General Contractor; any resulting schedule impact is not the responsibility of Goliath Drywall. The client's selection and purchase of any package on this website constitutes affirmative agreement that the scope purchased is cosmetic and finishing labor that does not require a permit, and the client assumes full responsibility for any permitting determination made by their local authority having jurisdiction.

  20. 20
    Promotional Offers & Bundled Add-Ons

    Any item described on this website or in marketing materials as 'free,' 'complimentary,' 'included at no cost,' 'on the house,' or as a stated dollar 'value' bundled with a qualifying package (including but not limited to the complimentary door install offered with closet build-outs) is a promotional add-on. Promotional add-ons have zero standalone cash value, are non-transferable, non-redeemable for cash or credit, may not be substituted, may not be applied to other purchases, and may not be invoiced separately. If the qualifying package is canceled, downgraded, refunded, charged back, or otherwise not completed and paid in full, the promotional add-on is automatically forfeited; if the promotional add-on has already been performed, its full stated retail value is added back to the balance owed and becomes immediately due. Promotional offers may be modified, suspended, or discontinued at any time without notice and do not create any ongoing entitlement.

    Chargebacks, Disputes, Arbitration & Governing Law

    The client agrees that any billing dispute will first be raised directly with Goliath Drywall in writing (email to corporate) and that Goliath will be given fourteen (14) calendar days to investigate and cure before any payment-card chargeback, ACH reversal, or banking dispute is filed. Filing a chargeback without first providing this written notice and cure period is a material breach of this agreement, and the client agrees to reimburse Goliath for all chargeback fees, processor penalties, administrative costs, and reasonable attorneys' fees incurred. All disputes arising out of or relating to any Goliath Drywall quote, package, service, or transaction that are not resolved through the written cure process shall be resolved exclusively by final and binding arbitration administered by a single arbitrator in Miami-Dade County, Florida, under the Commercial Arbitration Rules of the American Arbitration Association. The client expressly waives any right to a jury trial and any right to participate in a class, collective, or representative action against Goliath Drywall. The prevailing party in any arbitration or enforcement proceeding is entitled to recover its reasonable attorneys' fees and costs. This agreement is governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Exclusive venue for any non-arbitrable matter (such as enforcement of an arbitration award or filing of a mechanic's lien) lies in the state and federal courts located in Miami-Dade County, Florida.

    Public Statements & Factual Misrepresentation

    Clients are encouraged to leave honest, good-faith reviews of their experience on any public platform. Nothing in this agreement restricts truthful customer feedback, criticism, or opinion. The client agrees, however, that knowingly false statements of material fact — including but not limited to claims that a package was paid for when it was not, that work was never performed when signed sign-off exists, that damage was caused by Goliath when documented photo-record shows otherwise, or that no terms were agreed to when an electronic acceptance record exists — are not protected and may give rise to claims for defamation, tortious interference, and damages. Goliath reserves the right to publish, in response to any such false public statement, the relevant written change-order trail, signed proposal, payment record, and project sign-off documentation in order to correct the public record.
